Right of Withdrawal for Consumers

(A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business or profession.)

Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day

- on which you or a third party named by you, who is not the carrier, have taken possession of the goods, if you ordered one or more items in a single order and the order is delivered together;

- on which you or a third party named by you, who is not the carrier, have taken possession of the last item, if you ordered several items in a single order and they are delivered separately;

- on which you or a third party named by you, who is not the carrier, have taken possession of the last partial shipment or the last piece, if you ordered an item that is delivered in multiple partial shipments or pieces.

To exercise your right of withdrawal, you must inform us (Holz Frank GmbH & Co. KG, Houbirgstrasse 9, 91217 Hersbruck, Phone: +49 9151 83310, Email: info@holz-frank.com) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached sample withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments received from you, including the cost of delivery (except for the additional costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within 14 days from the day on which we received notice of your withdrawal from this contract. For this repayment, we will use the same payment method that you used in the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment.

We may withhold the refund until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earlier.

You must return or hand over the goods to us or to the return label download: www.holz-frank.com/downloads/retour.pdf without undue delay and in any event not later than 14 days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the period of 14 days has expired.

You will bear the direct cost of returning the goods that can be sent by parcel post as well as the direct cost of returning goods that cannot be sent by parcel post. The cost for goods that cannot be sent by parcel post is estimated at a maximum of approximately 50 EUR.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion or Early Expiry of the Right of Withdrawal

The right of withdrawal does not apply to contracts:

  • for the delivery of goods that are not prefabricated and for which an individual choice or decision by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;
  • for the delivery of goods that can spoil quickly or whose expiration date would be quickly exceeded;
  • for the delivery of alcoholic beverages, the price of which was agreed upon at the time of the conclusion of the contract, which, however, can be delivered no earlier than 30 days after the conclusion of the contract and whose current value depends on fluctuations in the market over which the trader has no influence;
  • for the delivery of newspapers, periodicals or magazines with the exception of subscription contracts.

The right of withdrawal expires prematurely for contracts:

  • for the delivery of sealed goods which are not suitable for return due to health protection or hygiene reasons if their seal was removed after delivery;
  • for the delivery of goods which, after delivery, are inseparably mixed with other items due to their nature;
  • for the delivery of audio or video recordings or computer software in a sealed package if the seal was removed after delivery.
